1. Who provides Kreativo, and what these terms are
Kreativo ("the Service") is a personal project operated by Edward Motfolea ("the Operator", "we", "us"), resident in Italy, reachable at privacy@kreativo.cc.
Today the Operator is not acting as a business, professional or trader. The Service is offered free of charge, and the Operator derives no revenue from it. Section 8 explains what changes if a paid plan is introduced.
By creating an account, signing in, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. What the Service is, and what it is not
Kreativo lets a freelance creative record and review their own work and money: jobs and clients, fees, deposits and balances, deadlines, recurring jobs, subscriptions, fixed costs, budgets, goals and notes. It is one service with one account, used through the Mac app. An iPhone app is planned and is not available yet. This website, kreativo.cc, describes it and takes sign‑ups for the private beta.
It works entirely on figures you enter. It performs arithmetic on those figures (monthly income, amounts still owed, budget remaining, a share to set aside for taxes, progress against goals) and draws charts and reports from the result.
The Service explicitly does not:
- provide accounting, tax, legal, investment or financial advice. The tax set‑aside is a percentage you choose, applied by arithmetic, not an estimate of what you owe;
- connect to any bank, payment provider, accounting package or invoicing system;
- issue, send, collect or process invoices or payments of any kind;
- convert between currencies. Each amount stays in the currency you gave it, and totals are never added up across currencies;
- verify, audit or validate any figure you enter;
- share your data with other users, or offer any collaboration or publishing feature. The only way your data leaves your account is the private calendar link (section 6.1), and only if you share it.
Every number shown to you is a calculation over your own input. You are solely responsible for the accuracy of what you enter and for any decision you take on the basis of what the Service displays. For anything with legal or fiscal consequence, consult a qualified professional.
2.1 Access is by invitation
The Service is in private beta. You can ask for a place on the waiting list at kreativo.cc/beta, and we write to you when there is room. Two consequences worth stating plainly:
- Leaving your email on the waiting list is not a contract. It creates no right of access, no place in a queue and no promise of a date.
- Beta software is unfinished. Expect defects, changes and interruptions, and read section 13 in that light. Export your data (section 11) if it matters to you.
2.2 KreativoAI
The Service includes an assistant, KreativoAI, available to signed‑in accounts. It answers questions about the Service and prepares its forms for you. It runs on a third‑party language model (section 9), and three limits apply to it:
- It can be wrong. What it writes is generated text, not a verified statement about your account or about the law. Check it before you rely on it.
- It saves nothing. It opens the ordinary form, filled in; the record is created only when you press the button.
- It gives no advice. It does not give tax, legal, accounting or financial advice, and nothing it says is a professional opinion.
What you type into the assistant is sent to the model provider. Do not type into it anything you would not send to a third party, in particular passwords, card numbers, IBANs or security codes.
2.3 Reminders and calendars
Reminder emails, the calendar link and calendar sync on the Mac are conveniences, not guarantees. An email can be delayed, filtered as spam or not sent at all; a calendar app decides for itself how often it refreshes a subscription. Do not rely on them as your only record of a deadline.
3. Eligibility
You must be at least 18 years old to use the Service. By using it you represent that you are. The Service performs no age verification. If we become aware that an account belongs to someone under 18, we may delete it and its data.
4. Accounts and sign‑in
You may create an account with email and password (at least 8 characters; you may need to confirm your email address first), with Google, or with Google. With Google, authentication is delegated to Google, and we receive only what it shares: your account identifier and email address, and your name and profile picture where available.
Authentication is handled by Supabase (section 9). We never see or store your password. Password reset is performed by email.
You are responsible for the confidentiality of your credentials and for everything done through your account. The Service currently offers no two‑factor authentication and no session or device management. Tell us at privacy@kreativo.cc if you believe your account has been accessed without your authorisation.
One account holds one person's data. There is no shared, team or organisation account.
5. Test builds and sample data
Test versions of the app may include a demo mode with fictitious sample data (invented clients, jobs and amounts), so the interface is not empty. In demo mode your data is stored only on your Mac, nothing is transmitted to any server we control, and removing it or switching device destroys it permanently: we cannot recover it. The sample data refers to no real person or business. Demo mode is not part of the released app.
6. Your data and your content
You own what you enter. Jobs, client names, fees, notes, subscriptions, costs, goals and profile details remain yours. We claim no ownership of them.
You grant us only the narrow, revocable, non‑exclusive permission to store, transmit, process and display your data for the sole purpose of operating the Service for you. We do not use your data to train models, do not analyse it for any purpose of our own, do not sell it, and do not disclose it to third parties except the providers listed in section 9 and where required by law.
For accounts, data is stored in a database with row‑level security: every row is bound to your account, and the database refuses any read or write from another account.
Be aware, however: the Operator holds administrative access to the underlying database and could technically read the data it contains. We commit not to do so except where strictly necessary to investigate a fault you have reported, or where legally compelled.
Your data may include information about third parties: client names, contacts, amounts owed. You are responsible for having a lawful basis to record that information and for complying with applicable data‑protection law in respect of it. Do not enter special categories of personal data (health, political opinions, and the like).
How your personal data is handled is described in the Privacy Policy.
6.1 The calendar link
Your account has a private link that calendar apps can subscribe to, listing your upcoming deliveries. Whoever has the link can read it without signing in. Keep it as you would a password: share it only with your own calendar, and regenerate it in Settings if it ends up anywhere else. Regenerating switches the old link off at once.
7. Acceptable use
You agree not to:
- use the Service in breach of any applicable law;
- attempt to access, read or modify data belonging to another account, or to bypass the security that protects it;
- probe, scan, overload or attack the Service or the infrastructure it runs on, including automated access at a volume that degrades it for others;
- reverse‑engineer or tamper with the applications in order to circumvent their access controls;
- enter content that is unlawful, or that infringes someone else's rights;
- resell, sublicense or offer the Service to others as if it were your own.
KreativoAI has a fair‑use limit on the number of messages, shown in the application. The limits of the underlying providers (section 9) apply in any case.
8. Cost
The Service is free today. Nothing is charged, and there is no payment mechanism in the Service.
A paid plan, Studio, is being prepared. Screens in the applications may already describe it, and test versions of the apps may simulate a purchase: a simulated purchase charges nothing. Before anything can be bought:
- these Terms will be updated with the price, what Studio includes, how it is billed and renewed, how to cancel it, and your right of withdrawal as a consumer;
- the change will be announced in the application or by email (section 17);
- you will be charged only after you explicitly confirm a purchase. Your use of the Service will never become chargeable retroactively, and your data will never be held hostage to a paid plan: export stays available (section 11).
9. Third‑party services
The Service depends on providers whose own terms and privacy policies apply when you use it:
| Provider | Role | What reaches them |
|---|---|---|
| Supabase | Authentication and database hosting | Your email address, authentication data, and everything you store |
| Vercel | Hosting of this website and of the server functions behind the app | Your IP address, request logs, and requests while they are processed |
| Resend | Delivery of account emails, reminder emails and the beta waitlist emails | Your email address and the content of each email |
| Optional sign‑in | Only if you choose Google sign‑in: your Google account identity | |
| KreativoAI (Gemini API) | Only what you type into the assistant, plus the conversation and your display name |
We do not control these providers and are not responsible for their acts, omissions, availability or changes to their terms. An interruption at any of them may interrupt the Service.
The Service includes no analytics, tracking, advertising or telemetry of our own.
10. Availability, changes and discontinuation
The Service is a personal project. It is provided with no service‑level commitment: no guaranteed uptime, no guaranteed response time, no support obligation.
We may change, suspend, limit or discontinue the Service entirely, at any time. Where discontinuation is planned and we can reasonably do so, we will give advance notice and a window in which to export your data.
11. Backups, export and data loss
Keep your own backups. The Service provides a one‑click export of everything you have entered as a JSON file, and a matching import. Use it.
We make no commitment that your data is backed up, nor that it can be restored if it is lost, corrupted or deleted, whether by fault, provider failure or your own action. Several actions delete data irreversibly and say so before proceeding:
- Clearing your data removes your jobs, subscriptions, fixed costs, goals and notes.
- Deleting your account removes the account itself and everything attached to it (section 16).
- Importing a backup replaces the current contents.
Each of these asks for confirmation first. Once confirmed, the data is gone.
12. Intellectual property in the Service itself
The applications, this website, their source code, design, visual identity, name and logo belong to the Operator and are protected by copyright. All rights are reserved. These Terms grant you a personal, non‑exclusive, non‑transferable right to use the Service as offered, and nothing more.
Third‑party components used by the Service (including open‑source libraries and the Aileron typeface) remain subject to their own licences.
13. Disclaimer of warranties
To the fullest extent permitted by Italian law, the Service is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non‑infringement.
We do not warrant that the Service will be uninterrupted, error‑free or secure, that its calculations are free of defects, or that any data stored in it will be preserved.
While the Service is supplied free of charge and outside any commercial activity, no guarantee of conformity under consumer‑sales law arises. If a paid plan is introduced, the mandatory consumer guarantees will apply to it in full.
14. Limitation of liability
To the fullest extent permitted by Italian law, we shall not be liable for:
- loss, corruption or unavailability of your data;
- financial loss, lost income, lost business or lost opportunity arising from the use of, or inability to use, the Service;
- decisions you take on the basis of figures the Service displays, or a reminder that did not arrive;
- interruption, degradation or failure caused by a provider named in section 9.
This limitation does not apply to liability for wilful misconduct (dolo) or gross negligence (colpa grave), which under Article 1229 of the Italian Civil Code cannot be excluded or limited in advance. Nor does it exclude any other liability that applicable law does not permit to be excluded, including liability for death or personal injury and liability arising from the mandatory provisions of consumer and data‑protection law.
15. Indemnification
You agree to hold the Operator harmless from any third‑party claim, and from reasonable costs arising from it, that results from: your breach of these Terms; your unlawful use of the Service; or data you entered that you had no right to record or process. This does not extend to claims arising from our own wilful misconduct or gross negligence.
16. Suspension and termination
By you. You may stop using the Service at any time. In the application you can export a backup, clear your data, or delete the account outright; you can also simply sign out.
By us. We may suspend or terminate access to an account that, in our reasonable judgement, breaches section 7, threatens the security or availability of the Service, or exposes the Operator to legal risk. Any such action is taken manually by the Operator. Where circumstances allow, we will notify you at the email address on the account and give you an opportunity to export your data.
Deleting your data and your account. Two separate actions exist in Settings ▸ Danger zone:
- Clearing your data deletes the records you have created. It does not delete the account itself, which keeps your email address, name and profile settings.
- Deleting your account deletes the account itself, immediately. It removes your profile, every record, the calendar link and the record of reminders sent, and then signs you out.
Account deletion is immediate and permanent. There is no grace period and no copy retained for you: once confirmed, neither we nor you can restore the account, except from a backup you exported beforehand. Infrastructure backups held by our providers are outside our control and are overwritten on their own schedule.
If you cannot reach the in‑app action, write to privacy@kreativo.cc and we will delete the account within 30 days.
Sections 6, 12, 13, 14, 15 and 20 survive termination.
17. Changes to these Terms
We may update these Terms. The "Last updated" date at the top will change, and material changes will be announced in the application or by email to the address on your account before they take effect.
Continuing to use the Service after a change takes effect means you accept the revised Terms. If you do not accept them, stop using the Service and export your data.
18. Governing law and jurisdiction
These Terms are governed by the law of the Italian Republic. Disputes are decided by the court that is competent under Italian law. If you are a consumer, this is the court of the place where you live, and nothing in these Terms deprives you of any protection granted by the mandatory law of the country in which you habitually reside.
19. Miscellaneous
- Severability. If a provision is held invalid or unenforceable, the remainder stays in force.
- No waiver. Failure to enforce a provision is not a waiver of it.
- Entire agreement. These Terms, together with the Privacy Policy, are the whole agreement between you and the Operator regarding the Service.
- Assignment. You may not assign your rights under these Terms. We may assign them in connection with a transfer of the project, on notice to you.
- Language. These Terms are published in English, the language of the applications' interface.
